The petitioner seeks bail in anticipation of his arrest in connection with Shahpur Patori (Patory) P.S. Case No. 03 of 2018 dated 01.01.2018 instituted for the offences under Sections 307, 323, 324, 34, 341 and 504 of the Indian Penal Code.

The son of the informant was assaulted by one Ranjeet Sharma. When the informant came to the rescue of his son, he too was assaulted. Thereafter, it has been alleged that the petitioner and two others also assaulted him by fists and slaps.

Learned counsel for the petitioner has submitted that the informant and his son have received

Patna High Court Cr.Misc. No.31689 of 2018(3) dt.28-06-2018 2/2 two injuries. The first injury is attributable to the assault perpetrated by co-accused Ranjeet Sharma. So far as the second injury is concerned, three persons are said to have assaulted the informant, but only one injury has been found on his person. The aforesaid injury was found to be simple in nature.

The petitioner does not have any criminal antecedent and no cause of the occurrence also has been stated in the FIR.

Considering the aforesaid facts, the petitioner above named is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Samastipur in connection with Shahpur Patori (Patory) P.S. Case No. 03 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C.
