JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-10-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. 1340C of 2018 disclosing offences under Sections 420, 468, 120B of IPC. As per complaint case, the case of the complainant is that he got 3-1/2 decimals of land, vide judgment and title suit no. 90 of 1970. However, brother of the complaint in conspiracy with the other accused got the compensation paid to some other accused persons and petitioner is said to be one of the conspirator.

Submission of the learned counsel for the petitioner is that as a matter of fact, the other accused persons got the compensation for the sale of the land executed in his favour.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M.-I, Araria, in connection with Complaint Case No. 1340C of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
