JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 17-05-2023 In compliance with order dated 02.05.2023, the investigating officer of the case is present in Court alongwith copy of case diary. His personal appearance is dispensed with. Heard learned counsel for the parties.

The petitioner apprehends his arrest in a case registered for the offence under Sections 363 and 366(A) of the Indian Penal Code.

It is submitted on behalf of petitioner that the victim (daughter of informant), in her statement recorded under Section 164 Cr.P.C., has categorically stated that she herself went to Patna with this petitioner without informing her parents. The victim has stated her age as 20 years, wheres, learned Magistrate has assessed the age of victim to be 19 years. Petitioner has got clean antecedent.

Patna High Court CR. MISC. No.71681 of 2022(3) dt.17-05-2023 2/2 Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the statement of the victim recorded under Section 164 Cr.P.C., in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Biharsharif, Nalanda / concerned court in connection with Bind P.S. Case No. 149 of 2022 / G.R. No. 4474 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) anay/- U T
