Petitioner, already in custody, seeks bail in connection with Runnisaidpur P.S. Case No.281 of 2017, registered under Section 392 of the Indian Penal Code.

Submission is that except disclosure of the name of the petitioner in the confessional statement of other co-accused Sunil Das, there is no other material against the petitioner as the mobile recovered from possession of the petitioner is not looted one rather it is a VIVO mobile set, whereas in the FIR it is alleged that mobile is of SAMSUNG Company. The petitioner is in custody since 22.06.2017, charge-sheet has been submitted in this case and the petitioner has no criminal antecedent.

No.61225 of 2017 (3) dt.18-01-2018 2 /2 Having considered the said facts and circumstances, petitioner Gaurav Kumar @ Bara Babu is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Runnisaidpur P.S. Case No.281 of 2017.
