Dr. Ajeet Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 21-06-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Jogbani P.S.Case No. 115 of 2017 registered under Section 414 of the Indian penal Code and 27(b)(ii) and 28 read with 36(a)(c) and Drugs and Cosmetic Act, 1940. Allegation in brief is that petitioner was found carrying some psychotropic medicines which was to be delivered to another co-accused Ram Pravesh Sah.

Submission is that petitioner was carrier and the medicine was given to him by Ram Pravesh Sah to transport to his shop and petitioner is in custody since 25.07.2017 and still charge has not been framed because of non-appearance of another coaccused, moreover, this petitioner has no criminal antecedent. Having considered the aforesaid facts and circumstances, the petitioner, namely , Md. Salauddin, is directed to be released

Patna High Court Cr.Misc. No.61031 of 2017(5) dt.21-06-2018 2/2 on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned ACJM, Araria in connection with Jogbani P.S. Case No. 115 of 2017 with condition that one of the bailor must be his close family member. Petitioner shall remain physically present on each and every date during trial and in case of failure on two consecutive dates without any reasonable cause, his bail bond shall be liable to be cancelled.
