JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-11-2019 Since initially it is submitted that petitioner no.1, Atabul Ansari @ Sasur Atabul Ansari, has been arrested, hence, this application, so far as it relates to petitioner no.1 stands dismissed as having become infructuous.
Heard learned counsel for the petitioner and learned APP for the State.
The petitioner no.2, Samsun Khatoon @ Sas Samsun Khatoon, being the mother of the husband of the informant, is apprehending arrest in a case registered for the offences
Patna High Court CR. MISC. No. 74735 of 2019(2) dt.27-11-2019 2/3 punishable under Sections 498A,34 of the Indian Penal Code and Sections 3⁄4 of the Dowry Prohibition Act. The prosecution case is that the marriage between the informant and the son of the petitioner, Tanvir Ansari was performed on 24.05.2017, but subsequent to the marriage, further dowry demand of Rs.5,00,000/- was made and due to non-fulfillment of the same, torture was inflicted to the informant. Ultimately, she was driven out from the matrimonial house.
It is submitted by learned counsel for the petitioner that the thrust of accusation is against the husband of the informant and petitioner no.2, being the mother of the husband of the informant claims to reside separate from him. It is submitted by learned APP for the State that the petitioner is named in the FIR.
Considering the thrust of accusation against the husband of the informant, let the petitioner no.2 above named be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Araria, in connection with Forbesganj P.S. Case No.694 of
Patna High Court CR. MISC. No. 74735 of 2019(2) dt.27-11-2019 3/3 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
