This is an application for bail in connection with Marhowrah P.S. Case No. 394 of 2017 registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code.

Petitioners are brothers of husband of the deceased and it appears that there is allegation against the accused persons, including the petitioners and husband of the deceased is of causing death of the deceased as she has no issue. Admittedly marriage was solemnized 20 years ago.

Submission of learned counsel for the petitioners is that petitioners are brothers of husband of the deceased and no specific allegation is attributed against them and they are in custody for

Heard learned APP and learned counsel for the informant. They could not controvert the above submission of learned counsel for the petitioners.

Having heard both sides and in the facts and circumstances of the case, let petitioners, above named, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Shri Rajesh Prasad Singh, Judicial Magistrate, Saran at Chapra, in connection with Marhowrah P.S.Case No. 394 of 2017, subject to the conditions that (1) one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and (2) petitioners will co-operate in trial and appear in court as and when required, except on genuine ground, failing which their bail bonds shall be cancelled.
