In this case, the petitioner is seeking regular bail in connection with Masaurhi P.S. Case No. 336 of 2022, registered for the offences punishable under Sections 147, 149, 341, 323, 307, 504, 506 and 302 of the IPC.

As per allegation, 8-10 miscreants, equipped with iron rod, etc. came to cyber cafe and attacked Ankit Kumar, the cousin of the informant. The accused persons fled away from the place of occurrence.

The learned counsel for the petitioner has submitted that he was not arrested at the spot and in his confessional statement, two accused persons, whose names figured, have been granted bail. On the other hand, the learned APP has opposed the

Patna High Court CR. MISC. No.72529 of 2022(2) dt.20-03-2023 2/2 prayer for bail and submitted that the accused persons, including the petitioner, badly assaulted the cousin of the informant, who went into coma and lost his life during course of treatment. The petitioner was identified in CCTV footage by the person assembled there and he confessed his guilt.

In my view, the petitioner does not deserve the privileges for bail, which is hereby rejected.
