The petitioner seeks regular bail in connection with Mufassil P.S. Case No. 233 of 2017 for the offences punishable under Section 30/32 of the Bihar Excise Act, 2016. The allegation against the petitioner is that when the police had conducted raid in the house of one Dharam Mandal, where the petitioner is said to have been sitting, two bottles of Royal Stage containing 750 Ml were recovered from under the bed. It has further been alleged that from the boat standing in the river, behind the house of Dharam Mandal, five bags containing various quantities of illicit liquor was recovered. The learned counsel for the petitioner submits that
Patna High Court Cr.Misc. No.62739 of 2017 (2) dt.17-01-2018 2/2 the petitioner was just sitting in the house of said Dharma Mandal and no recovery has been made from his possession. It is further submitted that the petitioner has no criminal antecedent and he is in custody since 5.10.2017.
Considering the nature of accusation, the period of custody already undergone and the fact that the petitioner has a clean antecedent, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise), Munger in connection with Mufassil P.S. Case No.233 of 2017.
