The petitioner is apprehending arrest in a case registered for the offences punishable under sections 419 and 420/34 of the IPC.
The prosecution case is that the petitioner allowed one Brajesh Kumar to appear at Police Recruitment Examination. It is submitted by learned counsel for the petitioner that the petitioner was not aware that Brajesh Kumar was appearing in the examination in question at his place. It is further submitted that even assuming the accusation to be true, a case under section 419 of the IPC is made out, which is bailable. Non-grant of bail will jeopardize the future career of the petitioner. Statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent. The petitioner

Considering the nature of accusation and the submissions made by learned counsel for the petitioner, let the petitioner above named be released on anticipatory bail in the event of arrest or surrender within 12 weeks on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Katihar in connection with Katihar Town P.S. Case No. 666 of 2014. The prosecution will be at liberty to file application for cancellation of bail bonds of the petitioner if he fails to cooperate in the investigation or during trial.
