JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-10-2019 This is an application for grant of anticipatory bail in connection with Moro P. S. Case No. 54 of 2017, disclosing offences under Sections 153, 153(A), 295, 295(A), 120B and 353 of IPC.

As per F.I.R. there is allegation against the petitioner that on the eve of 'Bakrid' some antisocial elements were committed criminal harmony and it is said that two persons were talking to create communal violence between two community and petitioner was made accused along with one other accused.

Submission of the learned counsel for the petitioner is that except suspicion there is nothing against him and another accused has been granted privilege of anticipatory bail by a Coordinate Bench of this Court, vide order dated 12.09.2019

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M.-VII, Darbhanga, in connection with Moro P. S. Case No. 54 of 2017, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) Sunil Shukla/- U T
