2. The petitioner seeks pre-arrest bail in connection with Marhawra P.S.Case No.371 of 2024, registered for the offence punishable under Sections 30(a) of Bhar Prohibition & Excise Act, 2022.

3. As per the allegation made in the FIR, 20 ltrs. of country-made liquor were recovered from a Motorcycle bearing registration no.JH10BJ 5813 and the petitioner succeeded in fleeing away from the place of occurrence.

4. Considering the nature of allegation made in the FIR against the petitioner, I am not inclined to enlarge the petitioner on pre-arrest bail.

5. However, considering the peculiar fact that the

No.76376 of 2024(2) dt.04-12-2024 2/2 motorcycle was parked at the public place, which is accessible to everyone, the petitioner, if so advised, may surrender before the learned District Court and seek regular bail. The learned District Court is directed to consider the regular bail application of the petitioner on the same day and pass a reasoned order in accordance with law.

6. Accordingly, the present bail application is disposed of.
