The petitioner apprehends his arrest in connection with Laheriasarai P.S. Case No. 306 of 2018, registered under Sections 307, 379 and other allied Sections of the Indian Penal Code.

The accusation is that wife of informant, Ashok Sah, was going to grocery shop for purchasing of household articles but in the way, petitioner caught hold her hand. On protest, she fled away from there and reached at her house and informed to her husband. Thereafter, informant went at the house of petitioner to make complaint then Dilip Das, father of petitioner, gave iron rod blow causing injury at his head. At that time,

Patna High Court CR. MISC. No.68437 of 2019(2) dt.31-01-2020 2/2 petitioner caught hold his hand and petitioner and Dilip Das started to cause assault to him.

Learned counsel for the petitioner submits that, in fact, due to some dispute arose in relation to settlement of marriage of daughter of the informant, quarrel took place in between the informant and Dilip Das, father of the petitioner but the petitioner has falsely been implicated in the present case due to ulterior motive. Further submission is that petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga in connection with Laheriasarai P.S. Case No. 306 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
