JUSTICE ASHUTOSH KUMAR ORAL ORDER 04-07-2018 The petitioner seeks bail in anticipation of his arrest in connection with Suppl. Mansi P.S. Case No. 129 of 2017 dated 14.06.2017 instituted for the offences under Sections 341, 323, 386, 506, 379, 307, 34 of the Indian Penal Code and Section 27 of the Arms Act.

The informant is said to have been surrounded by the accused persons including the petitioner and thereafter was attacked by one Ranveer Singh on his back by a country made pistol. So far as the petitioner is concerned, he is alleged to have taken away Rs. 1500/- from the pocket of the informant. The accused persons also demanded from the informant an amount of Rs. 50,000/- as extortion money. The learned counsel for the petitioner has submitted

Patna High Court Cr.Misc. No.33186 of 2018 (3) dt.04-07-2018 2/2 that the allegation against the petitioner is of having taken away Rs. 1500/- from the pocket of the informant. True it is that the allegation against the petitioner is not serious but regard being had to the criminal antecedents of the petitioner, this Court is not inclined to grant anticipatory bail to him.

However, if the petitioner surrenders before the Court below and seeks bail, the Court below shall pass orders in accordance with law, without being prejudiced by the fact that the present anticipatory bail petition has not been entertained.
