2. The petitioner has prayed for regular bail in a case registered for the offence punishable under section 309(6) of B.N.S. and Section 27 of the Arms Act.
3. The case of the prosecution is that the informant was returning on his bike and as he reached near Bhandari, State Highway-78, he was intercepted. It is further alleged that he was being fired and his bike was taken away by the miscreants. The informant has description of the miscreants.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted that the FIR was lodged against unknown miscreants. During investigation, the name of
Patna High Court CR. MISC. No.70820 of 2025(2) dt.09-10-2025 2/2 this petitioner has come on the basis of confessional statement of co-accused Bharat. Nothing has been recovered from the possession of the petitioner. It has also been submitted that no TIP was conducted. Moreover, the petitioner is languishing in judicial custody since 15.07.2025.
5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail and submitted that petitioner is having criminal antecedent of one case.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Rahui P.S. Case No. 128 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate (1st Class) Nalanda at Biharsharif.
