1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 191(2), 126(2), 115(2), 109, 303(2), 351(2), 352 and 190 of the BNS as well as Sections 3 and 4 of the Prevention of Witch (Daain) Practices Act, 1999.

Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and petitioner no. 1 is aged about 70 years and petitioners no. 2 and 3 are women and the informant alleges that on 28.06.2025, at 12:00 noon, he heard hulla in front of his house and thus came out when he saw

Further Ranjan Kumar assaulted him by lathi causing injury on his head and when his brother, wife and father came to save him, the accused persons assaulted them causing injury on head of his wife Daulti Devi. Thereafter Birendra Rajvanshi assaulted the father of the informant by rod causing injury on his head and his thumb fell down on the ground and accused also injured Jagdish Rajvanshi while Chanchala Kumari (petitioner no. 3) and Ranjan Kumar snatched Jitiya and nose pin of the mother of the informant and Ranjan Kumar torn the blouse of his wife and also assaulted her by lathi. Further, the reason for the occurrence is that the accused are of the opinion that his sister-in-law is a witch.
4. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is further submitted that from perusal of the allegation as alleged in the FIR, it would manifest that allegation against the petitioners is general and omnibus in nature. It is next submitted that petitioners no. 2 and 3 are women and petitioner no. 3 is aged about 19 years and the entire family has been implicated in the instant case. It is also submitted that specific allegation of assault is against Ranjan
Patna High Court CR. MISC. No.71027 of 2025(2) dt.04-11-2025 3/3 Kumar and Birendra Rajvanshi. It is further submitted that petitioner no. 1 has been implicated only with a view to coerce the entire family into submission.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
6. Considering the submissions made by the learned counsel for the petitioners, let the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/Successor Court in connection with Jamhore P.S. Case No. 167 of 2025, G.R. No. 1993 of 2025, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Satyavrat Verma, J) Kundan/- U T
