The petitioner apprehends his arrest in a case registered for the offence under Section 387/34 of the Indian Penal Code.

The prosecution case, in brief, is that informant got a call and the caller disclosed his identity as Munna Mishra and said that he used to extort money from people and demanded extortion money from him (informant).

Petitioner is not named in the F.I.R. Name of the petitioner transpired in this case on the basis of confessional statement of co-accused. During course of investigation, it has come that the alleged mobile, by which, extortion call was made, belongs to one Om Prakash Pandey @ Pintu Pandey and petitioner has got no concern either with the mobile or the SIM card. Petitioner claims clean antecedent.

Patna High Court CR. MISC. No.2821 of 2023(2) dt.09-05-2023 2/2 Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gopalganj in connection with Bhorey P.S. Case No. 335 of 2019, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
