JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-07-2018 The petitioners are apprehending their arrest in connection with Complaint Case No. 15474C of 2014, registered for offences punishable under Sections 420 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. Allegation as per the complain petition is that marriage of petitioner no. 3, who is the son of petitioner nos 1 and 2 was fixed with the daughter of complainant and a ring ceremony was held and in that Rs. 2 lacs was spent by the complainant and, thereafter, the marriage of petitioner no. 3 was fixed with some other girl and they are even not returning the money.
It has been submitted on behalf of the petitioners that in fact that complainant himself backed out and fixed the marriage of
Patna High Court Cr.Misc. No.34421 of 2018 (3) dt.13-07-2018 2/2 his daughter with some other person and only thereafter, the marriage of petitioner no. 3 was fixed.
Heard learned A.P.P. as well as learned counsel for complainant.
Having heard both sides, considering the facts and circumstances of the case, this application is disposed of with direction to the petitioners to surrender before the court below within a period of six weeks along with a bank draft of Rs. 1,00,000/- drawn in favour of the complainant, on which, the learned court of SDJM, Begusarai, shall enlarge the petitioners on bail on furnishing bond of Rs. 25,000 (Rs. Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction, in connection with Complaint Case No. 15474C of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C, as well as subject to the following conditions. It is made clear that the aforesaid amount so deposited will be subject to the outcome of the case.
