The petitioner apprehends his arrest in a case registered for the offence under Section 302/34 of the Indian Penal Code.

As per the prosecution case, this petitioner and other F.I.R. named accused persons committed the murder of brother of informant by inflicting knife blow.

It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case due to old enmity and local politics. As a matter of fact, petitioner is a student and pursuing B.P.T. course in Madhya Pradesh and on the alleged date, he was on duty and as such, petitioner cannot be said to be involved in the aforesaid crime.

However, learned counsel for the informant vehemently opposes the bail petition and submits that there is specific and direct allegation that he alongwith other co-accused

Patna High Court CR. MISC. No.71021 of 2022(5) dt.05-07-2023 2/2 persons inflicted several knife blow, as a result of which brother of informant died. Post-mortem report is also in consonance with the prosecution version.

Considering the same, the prayer for anticipatory bail of petitioner is rejected.
