The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 341, 323, 324, 307, 427,448, 504 and 34 of the Indian Penal Code. As per prosecution case, informant alleged that petitioner along with other co-accused persons came at her house and started abusing. Upon protest, they assaulted the deceased by means of lathi and gave knife blow upon his abdomen.
Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. There is a land dispute between the parties due to which, he has falsely been implicated in this case. There is case and counter case
Patna High Court CR. MISC. No.71472 of 2022(2) dt.17-03-2023 2/2 between the parties and both parties have sustained injuries as alleged in separate occurrence. It is also submitted that after two days delay FIR has been lodged and there is no repeated knife blow given by the petitioner. Petitioner has got no criminal antecedent, moreover he is languishing in judicial custody since 19.07.2022.
Learned APP appearing for the state has vehemently opposed the prayer of regular bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Jadhopur P.S. Case No. 129 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. Ist Class, Gopalganj.
