2. The petitioner seeks bail in connection with Belaganj P.S. Case No. 209/2018 registered for the offences punishable under Sections 30(a) and 30(d) of Bihar Prohibition & Excise Amendment Act.
3. As per the prosecution case, on July 18, 2018, at 2:40 PM, informant Deepak Kumar (A.S.I Belaganj PS Gaya) received information that illegal Mahua wine was being made and sold in Birbal Bigha village on the Falgu river bank. The police raided Birbal Bigha village, and upon seeing the police, six people tried to flee. Police caught Rajesh Kumar (son of Madheshwar Yadav) with 20 liters of country-made Mahua wine. He then disclosed names of other persons involved as:

Learned counsel for the petitioner submits that petitioner has committed no offense and his name was wrongly included by police, as only 20 liters of Mahua wine was recovered from the Falgu river bank where Rajesh Kumar was arrested and who disclosed the names of five other persons including the petitioner. Learned counsel further submits that the petitioner doesn't own the seized Passion Pro Motorcycle (BR020-6198) and no incriminating items were found from his possession or house, and all recovered articles were from a public place unrelated to him. Learned counsel further submits that other co-accused persons have been granted bail by Coordiante Bench of this Court vide order dated 04.09.2018 passed in Cr. Misc. No. 52520 of 2018. Learned counsel further submits that petitioner has four criminal antecedents and he is in custody since 25.08.2025.
5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.
6. Considering the facts and circumstances of the case, this application for regular bail is allowed.
