In this case, the petitioner is apprehending his arrest in connection with Siswan (M.H. Nagar) P.S. Case No. 58 of 2018 registered for offences under sections 147, 148, 149, 295(a), 296, 427, 435, 504, 506, 379 of the Indian Penal Code. The prosecution case in short is that the incident of communal violence took place during the Ram Navami procession on account of objectionable slogans being raised. The mob damaged the public property including the private property and created communal tension which led to lodging of different cases including the present one.
Learned counsel for the petitioner submits that the
Patna High Court Cr.Misc. No.36962 of 2018(2) dt.04-07-2018 2/2 route was already decided and the Ram Navami procession was going through the fixed rout but, the antisocial elements created the communal tension by pelting stones. There is no specific allegation against the petitioner.
Looking to the entire facts and circumstances of the case, let the petitioner, namely, Ravindra @ Ravindra Bhagat @ Ravindra Kumar Kushwaha, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-X, Siwan in connection with Siswan (M.H. Nagar) P.S. Case No. 58 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to condition that whenever the police will call the petitioner for investigation/interrogation, he will remain present and if he would not present himself, the privilege of grant of anticipatory bail shall be deemed to have been canceled.
