Petitioner seeks bail in a case registered for the offence punishable under Sections 30(a)(b), 37(c), 38 and 41 of the Bihar Prohibition and Excise Act, 2016.

Nine named accused persons including the petitioner are said to have been apprehended with 150 litres of country made liquor.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. He has no concern with the seized liquor. He has been falsely implicated in the case merely on suspicion while he was passing through the

Patna High Court CR. MISC. No.69043 of 2019(2) dt.04-12-2019 2/2 place of occurrence at the time of occurrence. Chargesheet in the case has been submitted. He has no criminal antecedent and has been languishing in custody since 08.07.2019. Similarly situated co-accused, namely, Pintu Manjhi, Ram Babu Manjhi and Santosh Manjhi have been enlarged on bail by a co-ordinate bench of this court vide order dated 06.09.2019 passed in Cr. Misc. No. 56734 of 2019.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna in connection with Agamkuan P.S. Case No. 627 of 2019, Special Case No. 5993 of 2019.
