2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 140(3), 103(1), 140(1), 238 and 61(2) of the B.N.S..

3. It is alleged in the F.I.R. that on 28.04.2025, uncle of informant went to attend the Court for a case regarding land dispute but did not return and on enquiry, he came to know that his uncle has been kidnapped by some persons of MohallaDevoriya by a Xylo vehicle bearing Registration No. BR02M2363.

4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has

Patna High Court CR. MISC. No.71587 of 2025(6) dt.02-02-2026 2/3 committed no offence. Petitioner is not named in the F.I.R. and he was not in litigating terms with the victim. Name of the petitioner transpired in this case during course of investigation and the only material that has come against him is that examination of the CCTV footage available near the place of occurrence and the mobile phone dump data, revealed the presence of several persons, including this petitioner, near the place of occurrence and on the routes through which the car which was allegedly used in kidnapping of uncle of informant was taken and this petitioner was in constant telephonic conversation with other accused persons. Save and except the same, there is no material on record to show the complicity of this petitioner in the alleged offence.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.

6. Considering the facts and circumstances of the case general and omnibus nature of accusation and materials that have surfaced during course of investigation, the prayer for grant of anticipatory bail to the petitioner is allowed.

7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named
