JUSTICE ASHUTOSH KUMAR ORAL ORDER 27-06-2018 The petitioner was granted anticipatory bail by order dated 05.04.2018 subject to his surrendering before the court below within a period of four weeks from the date of passing of the order. However, because of unavoidable reasons, the petitioner could not surrender before the court below within the specified period.

Hence the present petition for modification of the order for extension of time for surrendering before the court below.

Considering the nature of accusation and taking into account the reasons for not surrendering before the court below within the specified time, this Court is of the view that the order dated 05.04.2018, so far as the

Patna High Court Cr.Misc. No.36564 of 2018(2) dt.27-06-2018 2/2 petitioner is concerned is required to be modified. The order dated 05.04.2018 is modified to the extent that petitioner is given liberty to surrender before the court below within a period of four weeks from today and on his surrender, he shall be released on bail on his furnishing bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-I, Bhagalpur in connection with Sultanganj P.S. Case No. 240 of 2017.

The order stands modified as indicated above. The application is allowed.
