JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-12-2017 Earlier prayer for bail of the petitioner was dismissed vide order dated 11.07.2017 passed in Cr. Misc. No. 26823 of 2017, with observation that if the trial is not concluded within a period of four months, he may renew his prayer for bail in the court below itself.

It has been submitted that four months period has already expired and he has renew his prayer for bail before the court below but the same was rejected. It has further been submitted that petitioner has been in custody for about one year and the injuries caused to the injured was not on vital part of his body.

Heard learned A.P.P. also.

Having heard both sides, from perusal of the

Patna High Court Cr.Misc. No.62011 of 2017 (2) dt.20-12-2017 2/2 impugned order itself, it appears that out of six witnesses, four witnesses have already been examined and the case is pending only for examination of two witnesses. In such view of the matter, at this stage, I am not inclined to release the petitioner on bail. This application is accordingly dismissed.

However, the trial court is directed to concluded the trial within a period of two and half months from the date of receipt of this order.
