The petitioner seeks pre-arrest bail in connection with Pipara P. S. Case No.30 of 2018 registered under Sections 354 and 504 of the Indian Penal Code.
It is submitted by the learned counsel for the petitioner that the allegation made in the FIR is vague on the basis of which it cannot be said that the petitioner in any way outraged the modesty of the informant. It is further submitted that the petitioner is co-villager and due to dispute relating to drainage, an exaggerated version had been given by the informant in her written report, which was instituted after one day of the occurrence.
Patna High Court Cr.Misc. No.42970 of 2018 (2) dt.19-07-2018 2/2 Learned Additional Public Prosecutor for the State opposed the prayer for grant of pre-arrest bail to the petitioner. Considering the nature of allegation made in the FIR as also the submission that the petitioner has got no criminal antecedent, he is directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Masaurhi in Pipara P. S. Case No.30 of 2018, subject to the conditions as laid down under Section 438
(2) of the Code of Criminal Procedure, in the event of arrest or surrender before the court below within six weeks from today. (Ashwani Kumar Singh, J.) Kanchan/- U T
