2. In the present case, the petitioners seeks bail in connection with Sakatpur P.S. Case No. 73 of 2025, registered for the offences under Sections 109, 3(5) of the Bharatiya Nyaya
Patna High Court CR. MISC. No. 70419 of 2025(2) dt.13-10-2025 2/3 Sanhita, 2023 and Section 27 of the Arms Act.
3. As per the prosecution case, an accidental firing took place by the illegal weapon of the petitioner Navnit Kamti, in which the informant received a gun shot wound. The other petitioners were also present at the spot.
4. Learned counsel appearing on behalf of the petitioners submit that petitioners are innocent and have been falsely implicated in this case. From perusal of the FIR, it is clear that there was no intention to cause death of any person. The petitioners themselves took the informant to the hospital. No recovery of any illegal fire arm has been made. The whole occurrence appears to be a case of accidental firing as it has come in the FIR itself that the informants and others were snatching the pistol from the Manmohan Chaudhary to have a look at it and in this process a shot got fired which hit the informant. The petitioners are having clean antecedent except Manmohan Chaudhary who is having criminal antecedent of one case. The petitioners are in custody since 30.06.2025. The charge-sheet has been submitted.
5. Learned A.P.P. appearing for the State opposes the submission made on behalf of the petitioner.
6. Having regard to the fact and circumstances and

No. 70419 of 2025(2) dt.13-10-2025 3/3 submission made on behalf of the parties and considering the period of custody, submission of charge-sheet, the petitioners are directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate - 1st Class, Darbhanga in connection with Sakatpur P.S. Case No. 73 of 2025, subject to the condition laid down under Section 480(3) of the BNSS and other following conditions:
(i) One of the bailors will be a close relative of the petitioners.
(ii) The petitioners will remain present on each and every date fixed by the court below, if so required by the learned trial court.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioners will be liable to be cancelled by the court concerned.
