The petitioner is in custody since 03.09.2019 in connection with C-III No. 218 of 2019 for the offence registered under Sections 30 (a) of the Bihar Prohibition & Excise Act, 2016.

Learned counsel for the petitioner submits that there is no recovery from the conscious possession of the petitioner but from the motorcycle which does not belong to the petitioner. It is further submitted that the petitioner has no criminal antecedent.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on

Patna High Court CR. MISC. No.66930 of 2019(2) dt.24-10-2019 2/2 furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge 2nd cum Special Judge, Excise, Siwan in connection with C-III No. 218 of 2019.
