The petitioner apprehends his arrest in Digha P.S. Case No.282 of 2017 registered under Sections 144, 145, 146, 147, 148, 149, 114, 115, 342, 323, 307, 353, 395, 397, 186, 332, 333, 336, 337, 338, 427, 504 of the Indian Penal Code and 27 of the Arms Act.

The police lodged the case against the petitioner and other accused persons that accused persons did not allow them to measurement of the land allotted by Bihar State Housing Board because they are residing after constructing their house on the land. The police wanted to demolish the house of the petitioner, that is why, all the residents of Rajeev Nagar made peaceful protest.

It appears that the similar situated case, co-accused persons, namely, Deepak Kumar has already been granted anticipatory bail by order dated 12.12.2017 passed in Cr. Misc. No.59533 of 2017 by a coordinate Bench of this Court.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt / production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Patna in connection with Digha P.S.
