Learned counsel for the petitioner seeks permission to withdraw this application to file representation before the Chief Judicial Magistrate, in the light of observation made in Surendra Singh Vs. State of Bihar & Ors. Vide order dated 09.09.2022 passed in Cr. W.J.C. No. 153 of 2017 with analogous cases, where it has been categorically stated that Magistrate shall definitely monitor the investigation under Section 156(3) of the Cr.P.C.

Counsel for the State submits that this case may be disposed in the light of Surendra Singh Vs. State of Bihar &

Patna High Court CR. WJC No.1539 of 2022(2) dt.05-04-2023 2/2 Ors. Vide order dated 09.09.2022 passed in Cr. W.J.C. No. 153 of 2017 with analogous cases.

Permission granted.

The petitioner shall represent the entire matter before the Superintendent of Police, Patna and also before Chief Judicial Magistrate within four weeks and the Superintendent of Police, Patna and Chief Judicial Magistrate, as the case maybe, upon hearing the parties, they shall take appropriate decision in the light of representation made by the above said case i.e. Surendra Singh Vs. State of Bihar & Ors. passed in Cr. W.J.C. No. 153 of 2017 with analogous cases, with regard to the reliefs. With the aforesaid direction, this Cr. Writ petition is hereby disposed off.
