The petitioner seeks bail in Buxar (Industrial) P.S. Case No. 135 of 2017 registered for the offence punishable under Section 20(b) (ii) (c) 22, 27(A) and 29 of the NDPS Act. Allegation against the petitioner is of recovery of 2.5 Kg of Ganja from his car.

It has been submitted on behalf of the petitioner that the petitioner has been falsely implicated in this case at the instance of his brother as the petitioner had earlier lodged two cases against his brother. It has been further submitted that the police during investigation also prima facie found that some unknown persons broke the lock of the car and placed the alleged packet in it. Petitioner is in custody since 28.11.2017.

No.2308 of 2018(3) dt.02-02-2018 2/2 Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge NDPS, Buxar, in connection with Buxar (Industrial) P.S. Case No. 135 of 2017.
