JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Raghunathpur P.S. Case No. 163 of 2019 registered for the offences punishable under Sections 30(a) and 41 of Bihar Prohibition and Excise Act.

As per FIR police on information that several vehicles were parked near Chhath Ghat carrying liquor raided the place and recovered 1942 litres of liquor and petitioner and others are named in the FIR.

Submission of learned counsel for the petitioner is that except he is named in the FIR there is nothing against him and there is no source of information as to how his name has been transpired and there is no recovery from his possession and he has no criminal antecedent.

No.71040 of 2019(3) dt.26-11-2019 2/2 In view of above facts and circumstances, let petitioner surrender in the court below within a period of three weeks from the receipt of this order and on surrender he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional District Judge-II-cumSpecial Judge, Excise, Siwan, in connection with Raghunathpur P.S. Case No. 163 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
