JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 17-01-2018 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.

The petitioner wants to renew his prayer for bail which was earlier thrice rejected vide orders dated 30.03.2016, 30.11.2016 and 02.08.2017 passed in Cr. Misc. Nos. 5219 of 2016, 49288 of 2016 and 31775 of 2017 respectively, on the ground that the petitioner is suffering in custody since 19.11.2015, there is no motive to commit crime, only three injuries have been found on the person of the deceased, the allegation of assault is omnibus and general in nature, the prosecution evidence appears not probable and reliable and further up till now no prosecution witness has been examined and as such the petitioner deserves sympathetic consideration, though there was direction to conclude

The learned A.P.P. opposes prayer for bail of the petitioner by submitting that multiple injuries have been found on the person of the deceased and the petitioner has also assaulted the deceased brutally.

In the facts and circumstances stated above, finding no good ground for reconsideration of prayer for bail of the petitioner at this stage, again prayer for bail of the petitioner stands rejected in connection with Sessons Trial No. 373 of 2016 arising out of Singhia P.S. Case No. 126 of 2014/ G.R. No. 881 of 2014 pending in the court of the Additional Sessions Judge, Rosera at Samastipur.

However, considering the period of detention, let the trial be expedited and concluded as early as possible preferably within two months from the date of receipt/production of a copy of this order, failing which the petitioner, if at no fault, may be at liberty to renew his prayer for bail.
