The petitioner apprehends his arrest in Barun P.S. Case No.185 of 2017 registered under Sections 379, 411, 420/34 of the Indian Penal Code and under Sectiion 3, 4, 5 of Bihar Minor & Mineral Rules.

It is alleged that sand was being loaded in trucks to be transported somewhere else. Having seen the police, drivers fled away. Trucks bearing no.BR02W4602 and BR 26H 6293 and tractor bearignNo.BR26B 3213 was seized with sand. The learned counsel for the petitioner submits that petitioner is the owner-cum-driver of tractor bearing Registration No.BR 24E 4749 but the tractor was seized and petitioner has already been made accused in the case. There is nothing on record to

Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt / production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad in connection with Barun P.S. Case No.185 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
