JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 16-03-2023 Heard learned counsel for the petitioners and learned APP for the State assisted by learned counsel for the informant. The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 467, 468, 471, 420 and 120(B) of the Indian Penal Code pending in the learned court below.

Allegation against the petitioners is that after taking the money they have not returned the same to the informant nor registered the land in favour of the informant. The payment was made through RTGS or through the cheque of the Axis Bank. Learned counsel for the petitioners submits that the petitioners are innocent and have been falsely implicated in this

Patna High Court CR. MISC. No.71362 of 2022(2) dt.16-03-2023 2/2 case. He further submits that petitioner no.2 is a lady aged about 72 years of age and she is suffering from cancer. He further submits that petitioners have got no criminal antecedent as stated in para-3 of the bail application.

Learned APP for the State along with learned counsel for the informant opposes for prayer for bail. Considering the age and illness of petitioner no.2, let the petitioner, named above, in the event of her arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of the learned Court below, where the case is pending/Successor court, in connection with Sonepur P.S. Case No.482/2022, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. Insofar as petitioner no.1 is concerned, I am not inclined to enlarge the petitioner on bail in connection with Sonepur P.S. Case No. 482/2022. Accordingly, his prayer for anticipatory bail is hereby rejected.
