2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 302, 120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act.
3. The case of the prosecution, in short, is that on the order of co-accused Ajit Kumar and Sri Narayan Singh, the petitioner (Bhagya Narayan Singh) and one other co-accused person caught the husband and brother-in-law of the informant and thereafter, co-accused Ajit Kumar and Sri Narayan Singh made indiscriminate firing. Co-accused Ajit Kumar fired at the husband of the informant (Amit Ranjan) and co-accused Sri
Patna High Court CR. MISC. No.70863 of 2025(2) dt.09-10-2025 2/3 Narayan fired on brother-in-law of the informant, namely, Sumit Ranjan resulting into death of both persons.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. The learned counsel has further submitted that, from the perusal of the FIR, it is clear that the only role which has been attributed to this petitioner is that he along with one other co-accused, namely, Ravi Ranjan Kumar Singh caught hold of the two deceased persons. The allegation of firing is specific on other accused persons. The learned counsel for the petitioner has submitted that co-accused Ravi Ranjan Kumar, who was having similar nature of allegation, has been granted bail by a learned Coordinate Bench of this Court vide Cr. Misc. No. 64395 of 2022. It has been submitted that the case of this petitioner stands on similar footing. Moreover, the petitioner is languishing in judicial custody since 20.12.2024.
5. Learned APP appearing for the State has opposed the prayer of regular bail stating that the petitioner has one criminal antecedent.
6. Considering the aforesaid facts and circumstances of the case, this Court is inclined to enlarge the petitioner on
Patna High Court CR. MISC. No.70863 of 2025(2) dt.09-10-2025 3/3 bail. The above named petitioner is directed to be released on bail in connection with Kotwa P.S. Case No. 276 of 2022 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned District and Additional Sessions Judge-II, East Champaran, Motihari.
