2. The petitioners have prayed for regular bail in a case instituted for the offence under Sections 302 and 34 of the Indian Penal Code and Section 27 of the Arms Act.
3. The allegation against the petitioners along with others is of committing murder of the uncle of the informant.
4. It is submitted by learned counsel for the petitioners that petitioners have been falsely implicated in this case due to dirty village politics. They have committed no offence. From the perusal of the FIR, there is an admitted land dispute between the parties. During investigation, there is no consistent evidence
Patna High Court CR. MISC. No.75696 of 2023(2) dt.29-11-2023 2/2 has come against these petitioners to show their complicity in the present case. On the basis of suspicion, the name of the petitioners have come into light. No incriminating article has been recovered from the conscious possession of these petitioners. They are languishing in judicial custody since 01.09.2023.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as period of custody, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in connection with Koransarai P.S.
