The petitioner seeks bail in Jhajha P.S. Case No. 62 of 2017 registered for the offence punishable under Sections 302, 201/34 of the Indian Penal Code.

Informant in his written complaint has stated that on 12.03.2017, his son Lallan Kumar aged about 11 years had gone out of the house at about 6:00 pm but thereafter did not return and in spite of search being made by him and other family members, his son could not be traced. In the morning also, when he inquired from his relatives the whereabouts of the boy was not known. On 14.03.2017 co-villager Satendra Yadav informed him that the dead body of a boy is lying in the ditch and when

Patna High Court Cr.Misc. No.494 of 2018(2) dt.18-01-2018 2/2 he went there he found that it was the dead body of this son. FIR was also lodged against unknown.

It has been submitted on behalf of the petitioner that the petitioner has been falsely implicated in this case on mere suspicion and no incriminating material has been collected against the petitioner. Petitioner has got no criminal antecedent and is in custody since, 10.10.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Jamui in connection with Jhajha P.S. Case No. 62 of 2017.
