In this case, the petitioner is seeking anticipatory bail in connection with Barbigha P.S. Case No.288 of 2017, registered for the offence punishable under Section 379 of the Indian Penal Code.

As per the F.I.R., the mobile phone of informant was stolen, which was later on, recovered from one Sonu Kumar, who in his confessional statement, disclosed the name of the petitioner to be involved in the theft.

Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. However, if the petitioner surrenders before

Patna High Court Cr.Misc. No.36981 of 2018(2) dt.02-07-2018 2/2 the Court below within four weeks from today and prays for regular bail, the Court below will consider the same and pass appropriate order on the same day without being influenced by the order of this Court.
