ANJANA MISHRA ORAL ORDER 09-12-2019 Heard learned Senior Counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Shastrinagar P.S. Case No.676 of 2019 registered for the offence punishable under Sections 341, 323, 353, 379, 506/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is a Security Guard at Indira Gandhi Institute of Medical Sciences and was discharging his duties as a Security Guard there, where certain public officials of the Electricity Department came and there was some altercation on account of wrong parking, which initiated their wrath and they filed the case against the present petitioner making false and frivolous allegations. Learned counsel for the petitioner further submits

No.75811 of 2019(3) dt.09-12-2019 2/2 that nothing incriminating has been seized from the place of occurrence and the petitioner being a poor person has been drawn into the ambit of the present prosecution. Considering the aforementioned facts and circumstance of the case and the nature of allegations and that the petitioner has got no criminal antecedents, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Judge-IV-cum-ACJM, Patna, in connection with Shastrinagar P.S. Case No.676 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
