The petitioner apprehends his arrest in connection with Excise Case No.642 of 2021 registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from conscious possession of the petitioner rather recovery has been made from Bhuskhar (straw house) situated near Chulhai Chowk, Manhara road. The name of the petitioner has surfaced on the confessional statement of apprehended accused.
Having considered the above facts and circumstances
Patna High Court CR. MISC. No.70965 of 2022(2) dt.28-04-2023 2/2 of the case and the submissions advanced on behalf of the parties, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of A.D.J. VII-cumSpecial Judge, Excise II, Madhepura in connection with Excise Case No.642 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
