2. In the present case, the petitioner seeks bail in connection with Gogri P.S. Case No. 428 of 2024 registered for the offences under Sections 126(2), 109, 352, 351 (2), 191(2), 191(3) of the Bharatiya Nyaya Sanhita and Section 27 of the Arms Act.

3. As per the prosecution case, the petitioner shot at the brother of the informant.

4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has been falsely implicated in this case. The petitioner and informant's sides are agnates and there is land dispute and the sister-in-law of the petitioner has lodged Gogri P.S. Case No. 175 of 2024

Patna High Court CR. MISC. No.71408 of 2025(2) dt.14-10-2025 2/3 against the informant's sides including the victim. On the date of occurrence the petitioner was not present in his village. He was under treatment till 27.11.2024 and was discharged on 30.11.2024. Though, the informant has made specific allegation of firing against the petitioner, the victim has not made any such allegation and a general and omnibus allegation of firing has been made against a number of persons including this petitioner. The co-accused Amar Yadav has been granted bail vide order dated 07.05.2025 passed in Cr. Misc. No. 25241 of 2025. Another co-accused Dilip Yadav has been granted bail vide order dated 06.08.2025 passed in Cr. Misc. No. 33408 of 2025 The petitioner has one criminal antecedent and is in custody since 15.05.2025. The charge-sheet has been submitted.

5. Learned A.P.P. appearing for the State opposes the submission made on behalf of the petitioner.

Having regard to the fact and circumstances and submission made on behalf of the parties and considering the period of custody and submission of charge-sheet, the petitioner is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Gogri P.S.

Patna High Court CR. MISC. No.71408 of 2025(2) dt.14-10-2025 3/3 Case No. 428 of 2024, subject to the condition laid down under Section 480(3) of the BNSS and other following conditions: (i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
