The petitioner seeks bail in connection with Harsidhi P.S. Case No. 407 of 2016 registered for the offence punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the petitioner is of committing murder.

It has been submitted on behalf of the petitioner that the petitioner has been falsely implicated in this case due to land dispute. It has been further submitted that there is no evidence against the petitioner except the bald statement of the informant. Petitioner is in custody since, 11.10.2017. It has been further submitted that similarly situated co-accused persons namely,

Patna High Court Cr.Misc. No.457 of 2018(2) dt.17-01-2018 2/2 Munnilal Singh and Anirudh Singh have been granted bail by a co-ordinate bench of this Court vide order dated 01.09.2017. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Harsidhi P.S. Case No. 407 of 2016. (S. Kumar, J) ranjan/- U
