JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Thawe P.S. Case No. 119 of 2019, registered for the offences punishable under Sections 341, 323, 498 (A)/34 of the Indian Penal Code.

Petitioner happens to be father-in-law of the informant and as per F.I.R. an allegation of demand of Scorpio and for that she was subjected to cruelty.

Submission of the learned counsel for the petitioner is that so far as allegation of demand of Scorpio is concerned is not against the petitioner rather against one Vinay Kumar Choubey and other accused persons.

Heard learned A.P.P. Also.

Having heard both sides, considering the above submission, this application allowed. Let the petitioner, above

Patna High Court CR. MISC. No.68307 of 2019(3) dt.06-11-2019 2/2 named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Thawe P.S. Case No.- 119 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned.
