JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-01-2020 Petitioner seeks regular bail in connection with Katihar Town P. S. Case No. 526 of 2017 registered for the offence punishable under Section 20/22 of the N.D.P.S. Act. As per F.I.R. there is recovery of more than 05 kg Ganja from the possession of the petitioner. It further appears that he is accused in seven other cases also. Submission of the learned counsel for the petitioner is that the recovered ganja is less than commercial quantity and the petitioner is remained in custody for more about two and half years.
Heard learned A.P.P. also and perused the record, from which, it appears that the charge has been framed in the year 2018 and up till now only two witnesses have been examined. Having heard both sides, in view of the submission made above and considering the period of custody of the
Patna High Court CR. MISC. No.69072 of 2019 (3) dt.10-01-2020 2/2 petitioner, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Additional Sessions Judge-III, Katihar, in connection with Katihar Town P. S. Case No. 526 of 2017, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned with condition that he has to co-operate in disposal of the trial and appear as and when required.
It is made clear that before releasing the petitioner on bail, the address of the petitioner as well as bailor must be verified by the learned trial court.
Further condition is that after release on bail, the petitioner has to appear before the police station of his local area till the trial is concluded in this case, otherwise, his bail bonds shall be cancelled.
Let a copy of this order be communicated to the S.P., Katihar, for needful.
