The petitioners apprehend their arrest in Bajpatti P.S. Case No. 44/2017, registered for the offences punishable under Sections 147, 149, 341, 323, 324, 307, 354 and 379 of the Indian Penal Code.
The informant alleged that his sister-in-law Sheela Devi petitioner no. 4 asked him to partition the Bamboo trunks. The informant demanded money on such Sheela Devi called Deo Narayan Paswan, Indal Paswan and Ajay Paswan and other and on her order, they assaulted the informant and his family members. Learned counsel for the petitioners submits that no
Patna High Court Cr.Misc. No.39680 of 2018 (2) dt.10-07-2018 2/2 occurrence as alleged by the informant has ever taken place. On account of land dispute between the informant and his brother, petitioners have been falsely implicated in the case only because they are neighbour of the informant. The informant and others got superficial and simple injuries.
Considering the facts aforesaid and the fact that injuries found on the person of the informant and others are simple in nature and there is land dispute, the petitioners above-named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate (P), Sitamarhi in connection with Bajpatti P.S. Case No. 44/2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
