2. The petitioner apprehends his arrest in connection with Benipatti P.S. Case No. 176 of 2022, registered for the offences punishable under Sections 341, 323, 307, 504, 506, 379/34 of the Indian Penal Code.

3. As per allegation, when the informant was going to attend the call of nature, the petitioner and his son-in-law Madhav Pandey started abusing him. In the meantime, the wife of coaccused Madhav Pandey came and she also started abusing him and when the informant objected, the petitioner inflicted iron blow on his head. Further, the accused persons snatched golden chain from his neck.

4. The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.73190 of 2023(2) dt.09-11-2023 2/2 that the petitioner is a person of clean antecedent and has falsely been implicated in this case. The parties are agnates. There is land dispute between them. The petitioner has also suffered injuries and the injuries on the person of the informant are simple in nature.

Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate I, Benipatti in connection with Benipatti P.S. Case No. 176 of 2022, subject to the conditions as laid down under Section 438(2) Cr.P.C.
