1. Heard the parties.

2. The petitioner apprehends his arrest in connection with Mufassil P.S. Case No. 86 of 2024 dated 18.04.2024 registered under Section 379 of the I.P.C.

3. As per the prosecution case in the night of 14.04.2024 the F.I.R. named accused Md. Makdum stolen the cow of the informant worth Rs. 40,000/-, and thereafter, on 17.04.2024 he was caught by the co-villagers while selling the stolen cow.

4. Learned counsel for the petitioner submits that petitioner is not named in the FIR and there is specific allegation of selling the stolen cow against Md. Makdum. The name of the petitioner has been disclosed by Md. Makdum during "Panchayati" held at the instance of the informant. The petitioner is not having any criminal antecedent.

5. Regard being had to the submission made by the parties, taking into consideration the nature of allegation and the fact that petitioner is having no criminal antecedent, I am inclined to grant anticipatory bail to the petitioner.

6. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of C.J.M. Katihar, District - Katihar in connection with Mufassil P.S. Case No. 86 of 2024 subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
