The petitioner seeks regular bail in connection with Complaint Case No.651 of 2017 registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

Petitioner happens to be owner of Mahindra Mexico Savari Jeep and there is recovery of 297.200 ltrs. of liquor from the Jeep.

Submission of the learned counsel for the petitioner is that he was not arrested at the spot and he has been made accused only because he happens to be owner of the vehicle, having no criminal antecedent. He is in custody for six months.

Having heard both sides and in view of submissions as made above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge-2, Banka in connection with Excise Complaint Case No.651 of 2017 with condition to cooperate in the disposal of the trial. With the above direction, this application is allowed.
